The National Environmental Management Act 107 of 1998 and other legislation impose strict obligations on owners and/or operators of facilities that are potential causes of pollution. This has resulted in, amongst other requirements, the annual integrity testing of tanks and associated pipe work becoming a legal requirement for new station / tank owners.

In addition to corrective action in the event of tank or line failure, owners and/or operators could be subjected to legal sanction and liable for the substantial cost of environmental remediation, often resulting in site closures for extended periods. This constitutes the greatest threat to privately owned businesses who own bulk fuel or chemical storage facilities.
